  1. Definitions

  • Seller: Dive Talk Gear, LLC
  • Buyer: Any individual or entity purchasing a Dive Talk Go mCCR, components, parts or other items sold by Seller. Or, any individual or entity that is looking at the Sellers website.
  • Product: Dive Talk Go mCCR and any associated components, parts or, accessories.

  1. Introduction

By using this website and/or purchasing a Dive Talk Go mCCR, or various DT Go components, parts, or any other item, the Buyer agrees to the following terms and conditions.

  • The Buyer will read the Terms and Conditions carefully before making a purchase.
  • By using this website the Buyer is confirming that they are a legal adult, and understand that in order to purchase a DT Go, any components for the DT GO, or any other item, they must be a legal adult.
  • If the Buyer does not agree to these Terms and Conditions, they should stop using the website immediately.
  1. Purchase

    Agreement

  • By placing an order, the Buyer agrees to purchase the Product according to these terms and conditions. A binding contract will be formed once the Seller confirms the order.
  • The Buyer confirms that they understand that part of the Purchase Agreement is that approved training is required to purchase a DTG diving system, and also to purchase parts for the DTG diving system.
  • The Buyer confirms that in order to purchase a diving system, the Buyer must complete the required End User Acknowledgment’s and/or waivers.

  1. Prices and Payment

  • All prices are listed in USD and are subject to change without notice.
  • Payment must be made in full at the time of order placement.
  • Accepted payment methods include credit card, debit card, and other methods as specified on the checkout page.

  1. Shipping and Delivery

  • Shipping costs will be calculated and displayed at checkout.
  • Delivery times may vary based on the Buyer’s location and the availability of the Product.
  • The Seller is not responsible for delays caused by shipping carriers or customs clearance.
  • While DTG strives for excellence, at times there may be shipping delays that are beyond our control. These include, but are not limited to, unexpected back orders, shipping company delays, acts of nature. DTG will not be responsible for any costs incurred by the Buyer, due to these delays.
  • International shipments may be subject to additional shipping fees. These may include import fees, taxes, customs, and other costs. It is the Buyers responsibility to understand what these costs will be.  DTG shipping costs include the courier fees and insurance only.
  • If the Buyer does not pay additional shipping fees, the shipment may be held for further fees, returned to the sender, or other situations may arise.
  • Once the shipment leaves DTG, the Buyer will receive tracking information. It is the Buyers responsibility to contact the shipping company to track the order, and follow any instructions from the shipping company.

  1. Risk of Loss

All items purchased are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to the Buyer upon the Seller’s delivery to the carrier. DT Gear strongly encourages Buyers to fully insure each and every shipment.

  1. Warranty

The Product comes with a limited warranty, details of which are provided with the Product.  The warranty covers manufacturing defects only and does not cover damage caused by misuse, neglect, or unauthorized modifications.

  1. Returns and Refunds

  • Returns are accepted within 30 days of receipt of the Product.
  • The Product must be returned in its original condition and packaging.
  • The Buyer is responsible for return shipping costs unless the Product is defective.
  • Refunds will be processed within 14 days of receipt of the returned Product.

  1. Limitation of Liability

  • The Seller’s liability is limited to the purchase price of the Product.
  • The Seller is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Product.
  • Limitation of liability is not just for the Seller, but also includes their employees, consultants, members, agents, vendors or supplier.

  1. Errors & Cancellation

  • If the Seller mistakenly lists incorrect information or pricing, the Seller will not be obligated to follow through with the order.
  • The seller reserves the right to refuse, or cancel any confirmed order. Any order that is cancelled after it has been paid for, will be fully refunded.

  1. Accounts

  • The Buyer will be fully responsible for ensuring the confidentiality of the password to access the account.
  • If the Buyer feels that his account has been tampered with, they must contact DTG immediately to report that their account may be compromised.

  1. Intellectual Property

All content on the Dive Talk Go mCCR Purchase Website, including text, graphics, logos, and images, is the property of the Seller and is protected by intellectual property laws.

  1. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the state in which the Seller operates, without regard to its conflict of law principles.

  1. Changes to Terms and Conditions

The Seller reserves the right to modify these terms and conditions at any time. Any changes will be effective immediately upon posting on the website.
